Terms of Service

Welcome to Heirloom. These Terms of Service (“Terms”) govern your access to and use of the Heirloom mobile application (the “App”) operated by PRJCT LAZRUS LLC (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Account Registration
To use certain features of the App, you must create an account via Firebase Authentication. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
3. Nature of the Service
Heirloom is a cognitive regulation and wellness support tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. The App’s AI-powered features, including the KAIROS cognitive load engine and Companion, are designed to support wellness and self-regulation — they are not a substitute for professional mental health care. If you are experiencing a mental health crisis, please contact a qualified healthcare provider or emergency services.
4. User Content
You retain ownership of all content you create within the App, including journal entries, mood data, and wellness records (“User Content”). By submitting User Content, you grant us a limited, non-exclusive license to store, process, and analyze your content solely for the purpose of operating and improving the App’s features.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to any part of the App or its systems.
- Interfere with or disrupt the integrity or performance of the App.
- Use automated means to access or collect data from the App without our written permission.
- Reverse engineer, decompile, or attempt to extract the source code of the KAIROS engine or any other proprietary component.
- Impersonate any person or entity or misrepresent your affiliation.
6. Intellectual Property
The App, the KAIROS engine, ALETHEIA, CORTEX, and all original content, features, and functionality are owned by PRJCT LAZRUS LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the App without our prior written consent.
7. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.
8. Termination
We may suspend or terminate your access to the App at any time, with or without cause and with or without notice. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App’s Profile settings or by contacting us.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE APP IS NOT A MEDICAL DEVICE AND SHOULD NOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRJCT LAZRUS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
11. Indemnification
You agree to indemnify and hold harmless PRJCT LAZRUS LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the App, your User Content, or your violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Los Angeles County, California.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Effective Date.”
